By accessing or using BillArmor ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
BillArmor is a technology platform that provides automated analysis of medical bills to identify potential billing errors, overcharges, and duplicate charges. We are not a law firm, medical provider, insurance company, or financial advisor.
2. Service Description
Our Service provides:
- Automated analysis of medical bills using AI technology
- Identification of potential overbilling and duplicate charges
- Comparison against CMS (Centers for Medicare & Medicaid Services) fee schedules and CPT codes
- Generation of dispute letters and call scripts based on identified discrepancies
- Educational resources about medical billing practices
3. Important Disclaimers & Limitations
3.1 No Guarantee of Results
WE DO NOT GUARANTEE that hospitals, medical providers, or insurance companies will negotiate, reduce, or refund any charges identified by our analysis. Our Service identifies potential billing discrepancies based on available data, but the final decision to adjust billing rests solely with the billing entity.
3.2 Analysis Limitations
Our analysis is based on:
- Current CMS data and CPT codes - Medical billing codes and fee schedules are updated regularly. If your bill is old, the applicable codes and rates may have changed since the date of service.
- Automated algorithms - While our AI is sophisticated, it may not capture all nuances of your specific medical situation, insurance coverage, or contractual agreements.
- Information you provide - The accuracy of our analysis depends on the quality and completeness of the documents you upload.
3.3 Not Legal, Medical, or Financial Advice
Our Service does NOT provide legal advice, medical advice, or financial advice. The dispute letters and call scripts we generate are educational tools based on CMS codes and billing standards. They do not constitute legal representation. For legal matters, consult a licensed attorney. For medical questions, consult a healthcare provider.
3.4 Evidence Provided
While we provide dispute letters and call scripts citing specific CMS codes and billing standards as strong evidence of potential errors, we cannot guarantee that providers will accept this evidence or make adjustments. The effectiveness of negotiations depends on many factors outside our control.
3.5 Outdated Bills
If you upload bills that are more than 12 months old, our analysis may be less accurate due to changes in CMS fee schedules, CPT codes, and billing practices. We are not responsible for discrepancies arising from outdated billing data.
3.6 No Liability for Provider Actions
We are not responsible for any actions or inactions by hospitals, medical providers, billing companies, or insurance companies, including but not limited to: refusal to negotiate, denial of refunds, collection activities, credit reporting, or any other consequences of billing disputes.
4. User Responsibilities
You agree to:
- Provide accurate and complete information
- Upload only bills that you have the legal right to dispute
- Use the Service in compliance with all applicable laws
- Not use the Service for fraudulent purposes
- Verify all information before submitting disputes to providers
- Maintain the confidentiality of your account credentials
- Not share, sell, or distribute content generated by our Service without permission
5. Payment & Subscription Terms
5.1 Pricing: We offer both free and paid subscription tiers. Pricing is subject to change with 30 days notice to existing subscribers.
5.2 Billing: Paid subscriptions are billed monthly or annually in advance. All fees are non-refundable except as required by law.
5.3 Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
5.4 No Success Fees: Unlike traditional medical billing advocates, we do not charge a percentage of savings. Our fees are fixed subscription rates regardless of outcomes.
6. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, and algorithms, are owned by BillArmor and protected by copyright, trademark, and other intellectual property laws.
You retain ownership of the medical bills and documents you upload. By uploading, you grant us a limited license to process and analyze these documents to provide our Service.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- BillArmor shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not liable for any damages resulting from provider refusal to negotiate or adjust bills
- We are not liable for errors in our analysis caused by incomplete, inaccurate, or outdated information
- We are not liable for any collection activities, credit impacts, or legal actions by providers
8. Data Privacy & HIPAA
We take your privacy seriously and comply with applicable data protection laws, including HIPAA where applicable. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.
9. Termination
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, your right to use the Service immediately ceases.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
11. Governing Law & Disputes
These Terms are governed by the laws of the United States and the state in which our company is registered, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
